JATIN SHARMA's Key CASES DENIAL OF MAINTENANCE TO WIFE
"Maintenance" is an amount payable by the husband to his wife who is unable to maintain herself either during the subsistence of marriage or upon separation or divorce. Husband is duty bound to enable his wife to live life with dignity according to their social status and strata. Laws which are otherwise in favour of the distressed wife when are sought to be misused by declaring completely incorrect facts and also by suppressing the material aspect, the courts while awarding the maintenance in favour of wife should take into consideration the separate income and means of wife. If a wife is an employed person or has a Business
and earns definite sum by way of regular income and if the courts finds such income as sufficient for the purpose of enabling her to earn her livelihood, then certainly she cannot claim maintenance from her husband. Maintenance is to be fixed on the basis of actual earning of a person and not on the basis of his being able-bodied person. This book is not an attempt to advocate that wife are not entitled to maintenance but the courts should not treat the husband like "armless soldier" and pass the maintenance award in mechanical manner.
